Health Practices often comprise two or more owners at a business level, with staff of varying numbers. The greatest resource of any health practice is its staff and, as such, it is important to ensure they are managed well and that Practice Principals’ goals are aligned at all times. Of course this can be difficult to achieve and maintain at times. Challenges may exist on different levels of a Practice as follows:

Mediation is an effective means of settling disputes without the costly need to go to Court or engage in protracted negotiations between lawyers.

Conveyancing

We can assist with the purchase of your commercial premises or residential property including negotiation of contract, search reports (such as Building & Pest Report, Strata Report) and settlement.

Leases

We can assist with negotiation of your lease including items such as permitted use, rent free period, interest rates and other landlord driven provisions.

Sale/Purchase of Business

We can assist with the sale or purchase of a health practice including review/preparation of contracts, negotiations and settlement. We also cover leases and Service Agreements where required as part of the process.

Contracts

We can assist with the review/prepartion of contracts including employment, independent contractor, construction, pathology and many more health related contracts.

Business Structures

We will liaise with your accountant (or can refer you to our trusted colleagues) and establish an appropriate entity to suit your circumstances.

Common structures include a Company, Trust, and Sole Trader. We will also provide you with all associated Agreements, Constitutions, Registrations and Certificates.

Legal Advice

We can assist with legal advice on an ad hoc basis where required.

Industrial Relations Advice

We understand that staff are one of your most vital resources and understand the importance of knowing your rights and responsibilities with regards to staff entitlements and the management of complex and often difficult employment matters.

Workplace Health & Safety

Your Workplace Health and Safety (WHS) responsibilities must not be taken lightly.

You have a LEGAL obligation to ensure your Practice complies with WHS standards and regulations, all year round.

Your best defence, if you find yourself before a Court, is to have a comprehensive paper trail, setting out the reasonable steps you have taken to ensure a healthy and safe working environment for all your staff.

For most Practices, this compliance is a headache and something that you just don’t have time to even contemplate, let alone ensuring safe measures and legal paper trails are in place throughout the practice.

This is one of the many areas where Health Practice Creations takes the hard work out of the day to day worries. For a small monthly fee, our Management Plan takes the headache out of WHS for you.

Most WHS plans simply provide you with a thick hard-copy manual that takes up space on a shelf and is never looked at, or short training sessions are provided over a day or two, and you are left to work it out on your own.
